Terms and conditions

Last updated October 2026. Draft for legal review. Please read these terms before placing an order. By using this website you agree to them.

Draft for legal review. These terms are a working draft and must be reviewed by a Kenyan lawyer before publishing. Highlighted bracketed items, including the contracting entity's registration details, VAT treatment, the moment the contract is formed, pay on delivery limits, the cancellation window and the dispute resolution clause, still need to be confirmed.

1. About these terms

These terms and conditions ("terms") govern your use of the Jambo Fashion House website and the purchase of products from us, whether online, by WhatsApp or in our Nairobi store. They should be read together with our privacy policy, cookie policy, shipping policy, returns and exchanges policy and refund policy. Wholesale customers are also bound by our wholesale terms.

Nothing in these terms limits the rights you have under the Consumer Protection Act, 2012 or any other law of Kenya that cannot be excluded by agreement.

2. Who we are

Jambo Fashion House is a clothing retailer and wholesale supplier operating from Nairobi, Kenya. Legal entity: [Confirm: registered business name, registration number and KRA PIN]. Address: Golden Century 2, Othaya Road, Nairobi, Nairobi. Email: contact details to be confirmed. Phone: contact details to be confirmed.

3. Using the website and your account

  • You may browse and buy as a guest or create an account. You must be at least [Confirm: minimum age] years old to create an account.
  • You are responsible for keeping your login details confidential and for all activity under your account. Tell us immediately if you suspect unauthorised use.
  • Information you give us must be accurate and kept up to date, particularly delivery addresses and phone numbers.
  • We may suspend or close accounts that are used fraudulently, abusively or in breach of these terms.

4. Products, pricing and availability

  • All prices are shown in Kenyan Shillings (KES). [Confirm: whether prices include VAT].
  • Delivery fees are shown separately at checkout and depend on your delivery zone. See our delivery information.
  • Stock levels per size and colour are shown live on each product page. Occasionally an item may sell out between you adding it to your cart and completing checkout. If that happens we will contact you to offer an alternative, a wait or a full refund of anything you have paid.
  • We take care to describe products and show colours accurately, but screens vary and slight differences may occur. Measurements in our size guide are approximate.
  • If a pricing error is obvious and could reasonably have been recognised as a mistake, we may cancel the affected order and refund any payment made.

5. Placing an order

When you place an order you will receive an order confirmation by email, SMS or WhatsApp with an order number. This confirms that we have received your order. [Confirm: whether the contract is formed on order confirmation or on dispatch]. We may decline or cancel an order if we cannot verify payment, if the item is unavailable, if we suspect fraud or if a delivery address is outside the areas we serve.

You may cancel an order before it is dispatched by contacting us. [Confirm: cancellation window and process]. Once an order has been dispatched, our returns and exchanges policy applies.

6. Payment

We offer the following payment methods, subject to availability at checkout.

  • M-Pesa. Payments are verified on our server before an order is confirmed for dispatch. Please pay the exact amount and keep your transaction confirmation.
  • Card payments. Processed on secure hosted checkout pages provided by Shopify or Payhip. We do not store card details. Those providers' terms apply to the payment transaction.
  • Pay on delivery. Available in selected zones. You pay the courier in cash or by M-Pesa when the order arrives. [Confirm: order value limits, deposit requirements or zone restrictions]. Repeated refusal of pay on delivery orders may lead to this option being withdrawn for your account.
  • Bank transfer. Available only to approved wholesale accounts under our wholesale terms.
  • Order by WhatsApp. You may also send your order to us on WhatsApp. The same terms apply, and payment is arranged by M-Pesa or on delivery.

Orders are not dispatched until payment is confirmed, except for pay on delivery orders.

7. Delivery and store pickup

We deliver across Kenya through courier partners and offer free pickup from our Nairobi store. Delivery fees and estimated timeframes are set by zone and shown at checkout. Estimates are not guaranteed delivery dates. Full details are in our shipping policy. Risk in the goods passes to you when they are delivered to the address you gave, or when you collect them in store.

8. Returns, exchanges and refunds

Our returns and exchanges policy and refund policy explain when items can be returned or exchanged and how refunds are paid. Where goods are faulty, not as described or not fit for their ordinary purpose, you have remedies under the Consumer Protection Act, 2012 in addition to anything in those policies.

9. Promotions, referrals and affiliates

  • Promotional codes and sale prices are valid for the stated period and cannot be combined unless we say otherwise.
  • Our referral programme rewards existing customers who introduce friends, and our affiliate programme pays commission on tracked sales. Each programme has its own rules, which are shown within your account and form part of these terms. We may withhold or reverse rewards and commission on cancelled, refunded or fraudulent orders, and may remove participants who abuse the programmes.

10. Wishlist, newsletter and reviews

  • Your wishlist is a convenience feature. Saving an item does not reserve stock or hold a price.
  • You can subscribe to and unsubscribe from our newsletter at any time. See our privacy policy.
  • If you submit a review, photo or other content, you grant us a non-exclusive, royalty-free licence to display it in connection with our business. Content must be honest, lawful and your own. We may remove content at our discretion.

11. Intellectual property

The Jambo Fashion House name, logo, website design, photography and written content are owned by us or our licensors. You may not copy, reproduce or use them for commercial purposes without our written permission. Product images may be shared for personal, non-commercial use, for example to share a product with a friend.

12. Acceptable use

You agree not to use the website in any way that is unlawful, that interferes with its operation, that attempts to gain unauthorised access to any system or data, or that misuses the referral, affiliate or pay on delivery features.

13. Our liability

We are responsible for losses you suffer that are a foreseeable result of our breach of these terms or our negligence. We are not responsible for losses that were not foreseeable, that were caused by events outside our reasonable control, or that arise from your own breach of these terms. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be excluded under the laws of Kenya, including your rights under the Consumer Protection Act, 2012. [Confirm: any further limitation wording approved by counsel].

14. Electronic communications

By ordering online or by WhatsApp you agree that we may communicate with you electronically, and that order confirmations, receipts and notices sent by email, SMS or WhatsApp satisfy any legal requirement for such communications to be in writing. Electronic records and signatures are recognised under Kenyan law on electronic transactions.

15. Governing law and disputes

These terms are governed by the laws of Kenya. If a problem arises, please contact us first so we can try to resolve it quickly. If we cannot resolve it between us, disputes will be dealt with by [Confirm: chosen forum, for example the courts of Kenya or an agreed mediation or arbitration route]. You may also have the right to complain to a relevant regulator or consumer protection body.

16. Changes to these terms

We may update these terms from time to time. The version in force when you place an order applies to that order. The date at the top shows when the terms were last updated.
